Terms and Conditions of Website Use

1. Acceptance of These Terms
By accessing or using any part of the BeInCanada Immigration Services Inc. (“BeInCanada,” “we,” “our,” “us”) website, including its content, forms, and interactive features (collectively, the “Site”), you (“you” or “User”) acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions of Website Use (“Terms”). If you do not agree, you must immediately discontinue use of the Site.
2. About BeInCanada and Scope of Services
BeInCanada is a Canadian corporation headquartered in Ontario, Canada. Our regulated Canadian immigration consultant(s) (RCICs) and licensed paralegal(s) provide immigration-related consulting services under separate written retainer agreements.
Website Content Is Informational Only. Materials on the Site—including articles, checklists, videos, calculators, blog posts, and downloadable resources—are provided for general information and marketing purposes. They do not constitute legal advice or create a consultant-client, paralegal-client, or solicitor-client relationship. You should obtain personalized legal or immigration advice before acting on any information found here.
3. Modifications to the Site or Terms
We may update, suspend, or discontinue any part of the Site without notice. We may also revise these Terms at any time by posting an updated version and updating the “Last updated” date above. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

You may view, download, and print content from the Site for personal, non-commercial use only, provided you do not remove copyright or trademark notices. You must not:

8. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, BEINCANADA DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND AVAILABILITY. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEINCANADA, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our total cumulative liability to you for any direct damages shall not exceed CAD 100.
10. Indemnification
You agree to defend, indemnify, and hold harmless BeInCanada and its affiliates from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to your breach of these Terms or misuse of the Site.
11. Privacy and Data Protection
Our collection and use of personal information are governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the Site, you consent to the processing of your personal data as described in the Privacy Policy.
12. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to them or the Site shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute shall be submitted to the exclusive jurisdiction of the courts of the Province of Ontario, Toronto-region judicial district, except where prohibited by applicable consumer-protection statutes.
13. Severability
If any provision of these Terms is found invalid or unenforceable, that provision will be severed, and the remaining provisions will remain in full force and effect.
14. Entire Agreement
These Terms, together with any other legal notices or policies posted on the Site and any separate written retainer agreements between you and BeInCanada, constitute the entire agreement between you and BeInCanada regarding Site use and supersede all prior agreements or understandings related to the Site.
15. Waiver
No waiver of any provision shall be deemed a further or continuing waiver of that term or any other term. Our failure to assert any right under these Terms does not constitute a waiver of such right.
