6. Use of Artificial Intelligence Tools
We may use artificial intelligence (AI) tools to support our work, for example to help draft and proofread documents, translate or summarize materials, organize files and research publicly available legal information. When we do:
- We use only business-grade tools whose terms require the provider to keep your information confidential and not to use it to train their AI models.
- We limit the personal information entered into these tools to what is necessary for the task.
- AI tools do not give legal advice and do not make decisions about you or your file. All AI-assisted work is reviewed, and every submission and piece of advice is prepared and approved, by a licensed professional, including verifying any legal authority cited.
- We never use AI to write or materially change content that records your own evidence, such as personal narratives, Basis of Claim narratives, affidavits, statutory declarations or witness statements.
- Where IRCC, the Immigration and Refugee Board, a court or another authority requires a declaration of AI use, we make it.
- AI tools may process information on servers outside Canada, as described in section 7.
Clients choose in their retainer agreement whether to consent to the use of AI tools on their file, and may withdraw that consent at any time by written notice. You may also ask us at any time which tools and providers are being used on your file.
7. Storage Outside Canada
Some of our service providers, including our website host, our email and cloud-storage providers and the AI tools described above, may store or process information outside Canada, for example in the United States. Information stored outside Canada is subject to the laws of that country and may be accessed by its authorities.
8. Safeguards
We protect personal information with physical, organizational and technical safeguards appropriate to its sensitivity, including restricted office access, staff confidentiality obligations, password-protected and access-controlled systems, and secure transmission. Please do not send identity documents or other sensitive records through the website contact form; we will give you a secure way to share documents.
9. Retention
We keep client files for six (6) years after a file is closed, or longer where the law or our regulators require, and then destroy them securely. Website inquiries that do not lead to a retainer are deleted once they are no longer needed.
10. Cookies
Our website uses cookies for essential functions, security and analytics. You can control cookies through your browser settings; disabling some cookies may affect how the site works.
11. Access and Correction
You may ask to see the personal information we hold about you and ask us to correct it. We will respond within 30 days, as required by PIPEDA.
